Definitions
- App: Refers to the Animal Sanctuary application or Almost Level 5 websites available to use online.
- Service: The Content provided by Almost Level 5 through the App, including any updates or enhancements.
- User: Any individual who uses the Service.
- Terms: Refers to this document, which outlines the rules, conditions, and legal agreements governing the use of the Service.
- Almost Level 5: Refers to Almost Level 5 B.V., the owner and operator of the App.
- Content: Any text, images, or data provided by Almost Level 5 within the App.
By downloading, installing and using the App on your browser you (user) acknowledge and agree to the following terms:
1.0 Fair and Responsible Use
1.1 The Service is provided by Almost Level 5 for personal use only. It may not be used for commercial purposes without prior written consent from Almost Level 5.
1.2 Users must not interfere with or tamper with the App or Service, its related websites, or any technical systems associated with it.
1.3 Users must not attempt to reverse-engineer, modify, or otherwise tamper with the App or any associated software.
2.0 Limitation of Liability; Indemnity
2.1 By using the App or Service, you agree to use it at your own risk. Almost Level 5 is not responsible for any claims or damages you may experience from using the Service.
2.2 Almost Level 5 is not liable for any direct or indirect losses, including but not limited to loss of opportunity, profits, or data, that arise from your use of the Service. This applies whether the issue is due to a mistake, error, technical problem, virus, or any other cause, including factors outside our control, like natural disasters or theft.
2.3 You agree to defend, indemnify, and hold Almost Level 5 and its partners harmless from any claims, damages, or losses that result from your use of the Service, including any issues that arise from information you provide to us, such as defamation or infringement of intellectual property rights.
3.0 Applicable Law
3.1 The Service is operated by Almost Level 5 from its site in The Hague, The Netherlands. You and Almost Level 5 both benefit from establishing a predictable legal environment regarding the Service. Therefore, you and Almost Level 5 explicitly agree that all disputes, claims, or other matters arising from or relating to your use of the Service will be governed by the national laws of The Netherlands applicable therein.
3.2 Dispute Resolution: In the event of any dispute or claim arising out of or relating to these Terms, the Service, or any related matter, you agree to first attempt to resolve the dispute informally by contacting Almost Level 5. If the dispute cannot be resolved through informal negotiations, both parties agree to submit the matter to mediation or arbitration before pursuing litigation. The mediation or arbitration will take place in The Hague, The Netherlands, and both parties will share the cost equally unless otherwise agreed. If mediation or arbitration is unsuccessful, either party may then pursue litigation, subject to the governing law as set out in clause 3.1.
4.0 Intellectual Property
4.1 Intellectual property rights relating to the knowledge, services and other data made available to User by Almost Level 5 during the term of the agreement rest with Almost Level 5. User is expressly not permitted to reproduce, publish or make available to third parties the material and documentation without prior permission.
4.2 Any act in violation of the provisions of this article is considered an infringement of copyright.
5.0 Miscellaneous
5.1 If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, this will not affect the validity and enforceability of any remaining provisions. Almost Level 5 may assign any or all of its rights under these Terms to any party without your consent. You are not permitted to assign any of your rights or obligations under these Terms without the prior written consent of Almost Level 5, and any such attempted assignment will be void and unenforceable. These Terms constitute the entire agreement between you and Almost Level 5 regarding your use of the Service, and supersede all other Terms or purported agreements.
